Delhi HC stays trial court order granting bail to Arvind Kejriwal
Guwahati: In another jolt to the Aam Aadmi Party (AAP), the Delhi High Court on Friday stayed a trial court order granting bail to Delhi Chief Minister Arvind Kejriwal till the pronouncement of its order on Enforcement Directorate (ED) plea seeking stay on the bail order.
According to the vacation bench of Justice Sudhir Kumar Jain, it would take two to three days to pronounce the order on ED's stay application.
“In the meantime, the petitioner and the respondent shall be at liberty to file written submissions latest by Monday,” the court order noted.
On Thursday, the Rouse Avenue Court granted regular bail to Kejriwal in the money laundering case.
Vacation judge Nyay Bindu of Delhi's Rouse Avenue Court granted the bail upon furnishing a bail bond of Rs 1 lakh, despite opposition from the ED.
The ED had then requested the court to delay the bail bond process for 48 hours to allow them time to challenge the order in the High Court.
However, the trial court declined this request and stated that the bail order had not been stayed.
The court also issued a notice in ED's stay application and its plea challenging the trial court’s order granting bail to the AAP convenor.
During the hearing, ED's counsel SV Raju called the trial court’s decision as ‘lopsided’ and ‘one-sided’.
“Matter has been decided without considering the documents. Without considering the documents, how can you come to the finding that they are relevant or irrelevant? Without perusing the documents, you say that they are “irrelevant.” Even this is perverse,” the additional solicitor general had argued.
