Assam govt moves SC against anticipatory bail to Congress leader Pawan Khera
Guwahati: The Assam government has approached the Supreme Court challenging a recent order of the Telangana High Court that granted one-week transit anticipatory bail to Congress leader Pawan Khera.
Khera is an accused in a case registered in Assam over alleged defamatory remarks made against Chief Minister Himanta Biswa Sarma and his wife, Riniki Bhuyan Sarma. The state government filed the special leave petition on April 12 through advocate Shuvodeep Roy, and the matter is expected to be listed for hearing this week.
On April 10, the Telangana High Court granted interim protection to Khera, allowing him transit anticipatory bail for one week subject to conditions. The court directed that in the event of arrest, he be released on bail upon furnishing a personal bond, and that he cooperate with the investigation, including making himself available for interrogation as required.
The High Court observed that the petitioner had established a prima facie case for limited transit anticipatory bail, noting his apprehension of arrest based on what appeared to be reasonably supported allegations. It also directed Khera not to leave the country without prior permission from a competent court.
In its order, the court further noted that Khera retains the option of seeking appropriate legal remedies in Assam, where the case falls under the jurisdiction of local courts. It also observed that, given his public position, certain public remarks could potentially influence or prejudice the ongoing investigation.
The case against Khera was registered at the Guwahati Crime Branch Police Station under various provisions of the Bharatiya Nyaya Sanhita, including sections related to defamation and offences affecting reputation.
